Two key tenets of pretrial reform are the presumption of release under the least restrictive conditions and the use of an evidence- based risk assessment to inform those release conditions. In a risk-based system, some defendants will be found to pose too great a risk to public safety under any set of release conditions. Preventive detention of these defendants with strong due process requirements can offer courts a legal and evidence-based way to protect the community during the pretrial period.
