Most states (except New Jersey) have state statutes and laws regulating criminal rules of procedure. Forty-six states have statewide rules of criminal procedure typically promulgated by the Supreme Court or highest appellate court. In a number of states, statewide rules are promulgated by an association of trial court judges and referenced by the Supreme Court or state administrative office. In four states, no statewide rules of court are promulgated, or each circuit or district trial court publishes local court rules.
